Why Fathers Should Never Give Up On Child Custody Rights

Oct 29th, 2009 | By | Category: Parenting

Many people wonder if the courts will ever awaken and join the 21st century relating to child custody. It is clear that courts always favor the mother when it comes to divorce when child custody is the problem. This view is from the days when women stayed home and didnt work and looked after the kids? Were children better off? Were women better off? Some of these answers may never be revealed.

For a long time, the rights of fathers have got better and been great for fathers. However there is still a long way to go before there is real equality between mother’s and father’s when it comes to child custody rights. Those who win, of course, should always be the children, in the large majority of times, they are forgotten in the shuffle or tug-of-war game. With respect to visitation, support payments or custody, not every one will be happy in these situations or feel that they have been treated fairly.

Historically, a father’s rights in a child custody battle were practically non-existent. However, social workers and child psychologists are finally beginning to speak up, they are saying that children of divorce need their a fatherly influence, and guidance in order to provide some order in what some categorize as an unstable situation rather than throwing money at the situation (for expenses).

Fathers may not have primary custodial rights – in which the kids live with the father. The courts are now conceding to more ‘joint custody’ today than has been seen historically. The current child custody laws give fathers some say about their kids lives after the divorce and do not close them out indefinitely as as occured previously. Plus they can also use child custody mediation to get even rights.

What this means is that the father has some say on major decisions that will affect the childs upbringing. A dad has some input where a child goes to school if private school is considered, or being schooled from home. Also the father has some input in who looks after expenses as after school activities like dance or horseback riding lessons.

Many fathers should have equal rights so as to be considered the primary custodial parent equal to the mother, although it is not well known because judges tend to lean towards the mother in the belief that all children are better off with their mother. Nonetheless, child custody should come down to who is the best parent as oppoed to gender, especially in today’s day of non-traditional living conditions.

If a father is unable to get primary custody of the child or children, as so often happens, he will receive a more generous visitation schedule than that which has been provided to dads previiously. This is due in part to the never-ending efforts of father’s rights organizations. Other studies have shown us that the lack of a father’s relationship with his child or children has produced more drug use, clinical depression and juvenile problems.
